Please note that our general place of jurisdiction is Germany. Therefore only the German AGB is legally binding. The following text is for information purposes only.

General Terms and Conditions (GTC)

(The following GTC also contain legal information about your rights under the provisions governing distance selling and electronic commerce contracts.)

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries made by WAI Works UG (hereinafter referred to as the online shop) to consumers (§ 13 BGB).

A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

2. Contractual partner

3. Offer and conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Errors excepted.

3.2 By clicking on the [Order] button, you are placing a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

4. Right of withdrawal

4.1 Consumers have a fourteen-day right of withdrawal.

4.2 Tickets for admission to the WAI Galleries & Park as well as tickets for guided tours and the WAI Saisonkarte (WAI Seasonticket) are excluded from return.

You may withdraw from your contract within 14 days without giving reasons in writing (e.g. letter, fax, email) or – if the goods are delivered to you before the deadline expires – by returning the goods. The period begins upon receipt of this instruction in writing, but not before the goods are received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfilment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB (Introductory Act to the German Civil Code) as well as our obligations pursuant to § 312g paragraph 1 sentence 1 BGB (German Civil Code) in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation must be sent to:

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender the received services and benefits (e.g. advantages of use) to us, or if you are only able to do so in part or in a deteriorated condition, you must compensate us for the loss in value. You only have to pay compensation for the deterioration of the item and for any benefits derived if the use or deterioration is due to handling of the item that goes beyond the examination of its properties and functionality. ‘Examination of the properties and functionality’ means testing and trying out the respective goods, as is possible and customary in a retail store. Items that can be shipped by parcel post are to be returned at our risk. We will bear the cost of return shipping, regardless of the value of the goods. Items that cannot be shipped by parcel post will be picked up from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation declaration or the item, for us with its receipt.

Tickets for admission to the WAI Galleries & Park and tickets for guided tours are excluded from return.

4.3 The right of cancellation does not apply to the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs, or to the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by you.

4.4 Please return the goods to us as a prepaid parcel and keep the proof of posting. We will also be happy to reimburse you in advance for the postage costs if you request this, provided that you are not required to bear these costs yourself.

4.5 Please note that the modalities mentioned in paragraphs 4.3 to 4.5 are not a prerequisite for the effective exercise of the right of withdrawal.

4a. Return costs when exercising the right of withdrawal


If you exercise your statutory right of withdrawal (see cancellation policy), we will bear the costs of returning the goods, regardless of their value.

Refunds will only be made if the delivered goods correspond to those ordered and are in unused condition.

5. Prices and shipping costs

5.1 The prices stated on the product pages include statutory value added tax and other price components.

5.2 In addition to the prices stated, we may charge shipping costs. These will be clearly communicated to you on the product pages, in the shopping cart system and on the order page.

6. Delivery

6.1 Delivery is carried out by DHL.

6.2 The delivery time is usually: Germany 1-3 working days, EU 1-2 weeks, International 3-6 weeks.

7. Payment

7.1 Payment can be made either by PayPal or prepayment.

7.2 If you choose prepayment as your payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

7.3 You are only entitled to offset claims if your counterclaims have been legally established by a court of law, are undisputed or have been recognised by us in writing.

7.4 You may only exercise a right of retention if the claims result from the same contractual relationship.

8. Retention of title

The goods remain our property until full payment has been received.

Order process

Once you have found the product you want, you can add it to your shopping basket without obligation by clicking on the [Add to basket] button. You can view the contents of your shopping basket at any time without obligation by clicking on the [Shopping basket] button.

You can remove the products from the shopping cart at any time by clicking on the [Delete] button. If you want to purchase the products in the shopping cart, click on the [Checkout] button. Please then enter your details. Mandatory fields are marked with an *. Registration is not required. After entering your details and selecting the payment method, click on the [Check entries] button to go to the order page, where you can check your entries again. Click on the [Order] button to complete the order process. The process can be cancelled at any time by closing the browser window. You will find further information on the individual pages, e.g. on correction options.
